Terms of Use
Effective date: 01/01/2012
These Terms of Use apply to your use of snomasterusa.com (the "site") and to orders you place with SnoMaster USA ("we", "us"). By using the site or placing an order, you agree to these terms.
Using the site
- You agree to use the site lawfully and not to interfere with its operation or security, or try to access accounts or data that aren't yours.
- You are responsible for keeping your account password confidential and for activity under your account.
- The text, photos, videos, logos and other content on the site belong to SnoMaster USA or its licensors. You may not copy or reuse them without our permission.
- Links to other websites are provided for convenience. We are not responsible for their content.
Products and pricing
- Prices are in US dollars. Shipping and any applicable sales tax are added at checkout.
- We try to describe products and prices accurately. If we find a pricing or description error, we may correct it and cancel affected orders, even after you receive an order confirmation. If you have been charged, we will refund you.
- Products are subject to availability. We may limit quantities [CONFIRM].
- Product photos are for illustration. Specifications may change without notice.
Orders and acceptance
Your order is an offer to buy. The confirmation email we send when you place an order confirms that we received it. It is not acceptance. We accept your order when we ship it. We may refuse or cancel any order, for example if an item is unavailable, we can't verify payment, we suspect fraud, or the address is outside our shipping area. If we cancel an order you have paid for, we refund you in full.
Payment
We accept major credit and debit cards, processed securely by Authorize.net [CONFIRM accepted card brands]. By placing an order, you confirm that you are authorized to use the payment method. [CONFIRM whether the card is charged when the order is placed or when it ships.]
Shipping and risk of loss
We ship to the areas listed in our Shipping Policy, which also explains rates, processing times and what to do if your order arrives damaged. Title and risk of loss pass to you when the carrier delivers the order to your shipping address.
Returns and warranty
Returns, refunds and warranty claims are covered by our Returns & Warranty policy.
Product use and safety
- Read and follow the user manual before you install or use your product, including the instructions for power connections, ventilation and secure mounting in vehicles.
- Use the correct power supply and wiring. Incorrect installation can damage the product or your vehicle's electrical system and may void the warranty.
- Secure the product while driving. An unsecured fridge can cause injury in sudden braking or a collision.
Disclaimer and limitation of liability
Except for the warranty in our Returns & Warranty policy, and to the extent the law allows, the site and products are provided "as is", and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, including loss of food or other contents, and our total liability for any claim relating to a product is limited to the price you paid for that product. Some states don't allow these limits, so they may not apply to you.
Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Travis County, Texas.
Changes to these terms
We may update these terms from time to time. The version posted on this page when you place an order applies to that order.
